Abstrakt:

Právní etnografie byla až donedávna chápána jako integrální součást právní antropologie a jejích výzkumů práva uvnitř konkrétních společností a kultur. V některých starších národních tradicích evropské právní etnologie včetně české se však objevuje i její chápání jako jedné z právních spíše než sociálních věd. Nedávné posuny v pojetí etnografie, jež je stále častěji chápána jako autonomní metodologie či technologie produkce znalostí, představují možnost opětovného přehodnocení specifické pozice právní etnografie. Článek proto prozkoumává odlišnost pojetí etnografie v právní antropologii a nového vztahu „práva a etnografie“ jako dvou autonomních proměnných. Na podkladě několika nedávných právně-etnografických výzkumů hledá však také přetrvávající společné jmenovatele obou přístupů a snaží se ukázat jejich možný přínos pro tradičně pojatou metodologii právo-vědného výzkumu.
